Service Agreement for Speechtospec.com

This Service Agreement (“Agreement”) is made between ai.r Recruit (Company No. 14982917) of 4, The Courtyard London Road, C/O Intuita, Newbury, Berkshire RG14 1AX. (“Company,” “we,” “our,” or “us”) and the customer (“you” or “your”) for the use of Speechtospec.com, an AI-powered platform designed to generate inclusive job descriptions. By purchasing and using our services, you agree to the following terms and conditions:

1. Services Provided

Speechtospec.com allows users to generate job descriptions based on recorded job requirements using artificial intelligence (AI). These descriptions are designed to be inclusive and tailored to the needs of businesses seeking to create effective and equitable job postings.

2. Non-Redeemable Credits

2.1 Credit Purchase: You may purchase credits through Speechtospec.com, which can be used to generate job descriptions. The number of credits required for each job description may vary based on the service you select.

2.2 Credit Expiration: All purchased credits are non-redeemable and expire 12 months from the date of purchase. Unused credits after this period will automatically expire, and no refunds will be provided.

2.3 No Refunds: Credits are non-redeemable for cash or other services. Once purchased, credits cannot be refunded under any circumstances.

3. Customer Support

3.1 Support Availability: We provide customer support via email and/or chat between the hours of 9:00 AM and 5:00 PM UK time, Monday to Friday, excluding UK bank holidays.

3.2 Response Time: While we aim to respond to all inquiries as promptly as possible during support hours, we do not guarantee any specific response time.

4. User Obligations

4.1 Proper Use: You agree to use Speechtospec.com in accordance with this Agreement and all applicable laws. You will not use the service for any illegal, unauthorised, or unethical activities.

4.2 Accuracy of Information: You are responsible for providing accurate and up-to-date information when submitting job requirements. The AI-generated job descriptions will be based on the information you provide.

4.3 Ownership of Generated Content: You retain ownership of the job descriptions generated through the service. However, the underlying technology, including any AI models or algorithms used to create the descriptions, remains the intellectual property of AI Recruit Ltd.

5. Payment Terms

5.1 Pricing: The cost of credits and any other fees associated with the services will be displayed on the website at the time of purchase. Prices are subject to change at any time at the discretion of AI Recruit Ltd.

5.2 Payment Methods: All payments must be made through the available payment methods on Speechtospec.com. Payment is due at the time of purchase, and you must ensure sufficient funds are available to complete the transaction.

6. Limitations of Liability

6.1 Service Accuracy: While we strive to provide accurate and reliable job descriptions through our AI technology, we do not guarantee the accuracy, completeness, or fitness for purpose of any job description generated. The use of the service is at your own risk.

6.2 Service Interruptions: AI Recruit Ltd. shall not be liable for any interruptions to the service, including but not limited to technical issues, maintenance, or unavailability of support outside of the specified hours.

6.3 Limitation of Liability: In no event shall AI Recruit Ltd. be liable for any indirect, incidental, or consequential damages, including but not limited to loss of data, loss of revenue, or loss of business opportunity, arising out of or in connection with the use of Speechtospec.com.

7. Termination and Suspension

7.1 Termination by You: You may terminate your account at any time. However, no refunds will be provided for unused credits or remaining time on your account.

7.2 Termination by Us: We reserve the right to suspend or terminate your access to Speechtospec.com if you violate any terms of this Agreement or engage in any illegal or unethical activities.

7.3 Effect of Termination: Upon termination, your access to the service will be revoked, and any remaining credits will be forfeited. No refunds will be provided.

8. Amendments

We reserve the right to modify or amend this Agreement at any time. Any changes to the Agreement will be posted on our website, and your continued use of the service after the changes are posted constitutes acceptance of the new terms.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.

10. Dispute Resolution

Any disputes arising out of or in connection with this Agreement shall be resolved through negotiation. If the parties cannot resolve the dispute through negotiation, the matter shall be submitted to mediation or arbitration as mutually agreed.

11. Data Processing, Privacy, and Confidentiality

  • Compliance: Both the Customer and AI Recruit will comply with all relevant data protection laws, including the GDPR, UK GDPR, and UK Data Protection Act.

  • Data Controller: AI Recruit processes personal data as a controller in accordance with its Privacy and Cookies Notice or Recruitment Privacy Notice.

  • Data Processor: When acting as a processor for the Customer, AI Recruit will:

    • Follow the Customer’s instructions unless legally required to act otherwise.
    • Ensure confidentiality for personnel handling the data.
    • Implement security measures to protect personal data.
    • Assist the Customer in complying with data requests and audits.
    • Notify the Customer promptly of any data breaches.

  • Data Subject Rights: AI Recruit will assist with managing data subject rights like access, rectification, and erasure.

  • End of Service: Upon termination, AI Recruit will return or delete personal data, except where legal retention is required.

  • Candidate Consent: Candidates can withdraw their consent, requiring AI Recruit and the Customer to delete their data promptly.

  • Sub-processors: AI Recruit may use sub-processors but will provide 30 days advanced notice to the Customer, who can  terminate the contract if unsatisfied.

  • International Data Transfers: Transfers of personal data outside the EEA will follow appropriate safeguards, including Standard Contractual Clauses.

12. Confidentiality

  • Scope: Confidential information includes business, technical, and customer data disclosed during the service. Both parties must protect each other’s confidential information with reasonable care.

  • Use: Confidential information can only be used for fulfilling contract obligations. Disclosure to third parties is prohibited without consent, except for legal requirements.

By using Speechtospec.com, you acknowledge that you have read, understood, and agree to be bound by this Service Agreement.
